Welcome to OG Tackle. The terms "we," "us," and "our" refer to OG Tackle. We operate ogtackle.myshopify.com and all related products and services (the "Services"), powered by Shopify. These Terms of Service govern your use of our store. By visiting or purchasing from us, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

Section 1 — Eligibility

By using our Services, you represent that you are at least the age of majority in your state of residence. You are responsible for ensuring the accuracy of all information you provide, including billing, payment, and shipping details.

Section 2 — Products

We work to accurately represent our products. However, colors and print appearance may vary from what you see on your screen due to your device settings, monitor calibration, and the nature of the print-on-demand production process. We do not warrant that product quality or appearance will exactly match what is depicted in our store. All product descriptions are subject to change at any time without notice.

Section 3 — Orders

When you place an order, you are making an offer to purchase. OG Tackle reserves the right to accept or decline any order at its discretion. Your order is accepted only after payment is processed and we confirm acceptance. Because our products are made to order by our fulfillment partner Printify, we are generally unable to cancel or modify orders once accepted — please review your cart carefully before checkout. Returns and refunds are governed by our Refund Policy. You represent that purchases are for personal or household use, not for commercial resale.

Section 4 — Prices and Billing

Prices are subject to change without notice. The price charged will be the price in effect at the time of your order as shown in your order confirmation. Prices do not include applicable taxes, shipping, or handling charges unless expressly stated. You agree to provide accurate and complete payment information and authorize us to charge the applicable amount to your payment method.

Section 5 — Shipping and Delivery

All delivery times are estimates and are not guaranteed. Our products are printed and fulfilled by Printify, and production typically takes 2–7 business days before shipment. We are not liable for delays caused by Printify's production process, shipping carriers, or events outside our control. Once transferred to the carrier, risk of loss passes to you.

Section 6 — Intellectual Property

All content on our Services, including trademarks, text, images, graphics, and designs, is owned by OG Tackle or its licensors and protected by U.S. copyright and intellectual property law. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. All rights not expressly granted are reserved.

Section 7 — Third-Party Tools

We may provide access to third-party tools through the Services. These tools are provided "as is" without warranties of any kind. We have no liability for your use of third-party tools, and any use is at your own risk.

Section 8 — Third-Party Links

Our Services may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing third-party sites is at your own risk.

Section 9 — Relationship with Shopify

OG Tackle is powered by Shopify. All sales and purchases you make are directly with OG Tackle. Shopify is not responsible for any aspect of transactions between you and OG Tackle, including any injury, damage, or loss from purchased products. You release Shopify and its affiliates from all claims arising from your purchases with OG Tackle.

Section 10 — Privacy Policy

All personal information collected through our Services is subject to our Privacy Policy. Shopify also collects and processes information related to your use of the Services per the Shopify Privacy Policy.

Section 11 — Feedback

Any feedback, reviews, or suggestions you submit grant OG Tackle a perpetual, royalty-free, worldwide license to use, reproduce, modify, and publish such content for any purpose including improving our Services. You represent that you own all rights to submitted feedback and that it complies with these Terms. We are under no obligation to respond to, compensate for, or keep confidential any feedback you provide.

Section 12 — Errors and Omissions

We reserve the right to correct typographical errors, pricing mistakes, or inaccurate product information at any time without notice, including after an order is placed. In such cases, we may cancel the affected order and will attempt to notify you.

Section 13 — Prohibited Uses

You may use our Services for lawful purposes only. You may not use the Services to: violate any law; infringe any intellectual property rights; transmit harmful, fraudulent, or misleading content; spam or phish; scrape or extract data using automated tools; or interfere with the security or operation of the Services. We reserve the right to terminate access for violations without notice.

If you deploy an automated agent to interact with our Services, it must identify itself in all HTTP requests via the user agent string (format: "Agent/[agent name]"), must not mimic human behavior or bypass CAPTCHAs, and must respond truthfully when asked if it is automated. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Section 17 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OG TACKLE, ITS PARTNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS (INCLUDING SHOPIFY AND PRINTIFY) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Section 18 — Indemnification

You agree to indemnify and hold harmless OG Tackle, Shopify, and their respective affiliates, officers, employees, and agents from any claims, losses, or damages (including attorneys' fees) arising from your breach of these Terms, violation of any law, or misuse of the Services.

Section 19 — Severability

If any provision of these Terms is found to be unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force.

Section 20 — Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and OG Tackle regarding your use of the Services. Our failure to enforce any provision does not constitute a waiver of that right.

Section 21 — Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign or transfer these Terms at any time without notice.

Section 22 — Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. You consent to the exclusive jurisdiction of the courts located in Delaware for any disputes arising from these Terms.

We reserve the right to update these Terms at any time. Changes will be posted to this page with an updated date. Material changes will be communicated as required by applicable law. Continued use of the Services after changes are posted constitutes acceptance.
